- L’uso della bicicletta presuppone l’idoneità fisica e la perizia tecnica di chi intende condurla. Pertanto l’utente dichiara di essere dotato di adeguata capacità e di appropriata competenza senza porre alcuna riserva. Nel caso di utilizzo da parte di minori con la sottoscrizione del presente contratto il genitore affidatario oppure tutore del minore si assume tutte le responsabilità indicate nel presente contratto e dal codice civile, conseguentemente autorizza il minore all’utilizzo della bicicletta alle condizioni previste dal presente regolamento.
- La bicicletta è da utilizzarsi esclusivamente come mezzo di trasporto e da trattarsi con attenzione, buonsenso e diligenza, in modo da evitare danni sia alla stessa che ai relativi accessori. E’ vietato cedere la bicicletta in uso ad altri soggetti.
- L’utente è responsabile della bicicletta fino alla sua restituzione al gestore; è inoltre responsabile dei danni causati a se stesso, alla bicicletta, a terzi e a cose durante l’uso del mezzo. Al gestore non potrà essere richiesta nessuna forma di indennizzo.
- Durante il noleggio l’utente non gode di nessuna forma assicurativa, ne la bicicletta è coperta da assicurazione RC. L’utente è pertanto tenuto a rispettare le norme del codice della strada. Il gestore declina ogni forma di responsabilità in caso di utilizzo improprio del mezzo o di mancato rispetto delle norme del codice della strada.
- L’utente dev’essere in grado di sostituire la camera d’aria in caso di foratura.
- In caso di danni arrecati alla bicicletta e/o agli accessori, il gestore chiederà al cliente la somma necessaria per il ripristino originale della bicicletta in base ad una valutazione tecnica eseguita dal gestore stesso al momento della riconsegna.
- In caso di furto o smarrimento della bicicletta, l’utente dovrà risarcire il gestore dell’importo stabilito in 4.000euro (quattromila/00) per ogni bici tipo mountain bike a pedalata assistita oppure in 1000 euro (mille/00) per ogni bici tipo mountain bike muscolare.

RENTAL FORM
- The use of the bicycle requires adequate physical fitness and technical ability on the part of the rider. The user therefore declares, without reservation, that they possess the necessary skills and competence. In the case of use by a minor, by signing this agreement the parent or legal guardian assumes all responsibilities set out in this agreement and under the Civil Code, and consequently authorizes the minor to use the bicycle under the conditions provided herein.
- The bicycle must be used exclusively as a means of transport and handled with care, common sense, and diligence, in order to avoid damage to both the bicycle and its accessories. It is strictly forbidden to lend or transfer the bicycle to third parties.
- The user is responsible for the bicycle until it is returned to the rental operator; the user is also responsible for any damage caused to themselves, the bicycle, third parties, or property during its use. No compensation of any kind may be claimed from the rental operator.
- During the rental period, the user is not covered by any insurance, nor is the bicycle covered by third-party liability insurance. The user is therefore required to comply with all road traffic regulations. The rental operator declines all responsibility in case of improper use of the bicycle or failure to comply with road traffic laws.
- The user must be able to replace an inner tube in case of a puncture.
- In the event of damage to the bicycle and/or its accessories, the rental operator will charge the customer the amount necessary to restore the bicycle to its original condition, based on a technical assessment carried out by the operator at the time of return.
- In the event of theft or loss of the bicycle, the user shall reimburse the rental operator in the amount of €4,000.00 (four thousand/00) for each electric mountain bike, or €1,000.00 (one thousand/00) for each non-electric mountain bike.
